On September 1st, the National Institute for the Protection of Consumer Rights (Pro-Consumidor) issued Resolution No. 1579-22 which purpose is to demand mandatory compliance with the Dominican Standard (NORDOM) 53 on general labeling of prepackaged foods.
In that sense, in summary, the resolution:
1) reiterates the provisions contained in NORDOM 53, particularly the content and information that must be declared on the labeling of prepackaged foods.
2) grants a period of 120 calendar days for merchants, manufacturers or importers to adapt the labels of their products in accordance with the provisions of NORDOM 53;
3) upon expiration of the aforementioned period, determines that it will proceed with the taking of samples and laboratory analysis according to the technical protocol of each product to verify what is declared on the label;
4) if the existence of products that do not comply with the labeling standards is verified, determines their confiscation.
5) finally reiterates and warns of the application of the sanctioning provisions for infractions contained in Law No. 358-05 General Law for the Protection of the Rights of the Consumer or User, for alteration, adulteration, falsification or fraud, as of standardization, documentation and conditions of sale or supply, which refer to labeling.
